Low-Income Support In 1984, the Commission established a Lifeline program designed to promote universal service by providing low-income individuals with discounts on the monthly cost of telephone service. 1 The Commission expanded that program in 1985. 2 In 1987, the Commission adopted Link Up America (Link Up), designed to help low-income households pay the initial costs of commencing service. 3 After passage of the Telecommunications Act of 1996 (1996 Act), 4 the Commission adopted expanded rules. 5 In June 2000, the Commission further expanded the Lifeline and Link Up programs to address the particularly dire needs of those living on tribal lands. 6 In April 2004, the Commission released an Order expanding the federal default eligibility criteria to include an income-based criterion and additional means-tested programs. 7 The Order adopted federal certification and verification procedures that require states, under certain circumstances, to establish procedures to minimize potential abuse in the program. The Order also contained a Further Notice which proposed adding a broader income-based standard than the one adopted in the Order to further increase penetration rates. In March 2006, the nationwide telephone penetration rate among low-income households 8 was 86.3 percent. The nationwide telephone penetration rate for all households at the same time was 92.9 percent. Since 1985, when the Federal Communications Commission first established Lifeline to help low-income households afford the monthly cost of telephone service, penetration rates among the lowest income households have grown from 80% to 86.3%. States that have provided a full or high level of Lifeline support for telephone service for low-income consumers experienced an average growth in penetration rates for low-income households of 1.2% from March 1997 to March 2006. 9 In contrast, states that provided a basic or low level of Lifeline support experienced an average decline in telephone penetration rates for low-income households between March 1997 and March 2006 of 2.7%. 10 In 2006, more than 6.9 million subscribers paid reduced local rates under the Lifeline program whereas the Link Up program, which supports affordable connections to the network, connected more than 1.6 million telephone beneficiaries. The Commission’s rules are designed to satisfy the 1996 Act's mandates that rates be "affordable" and access be provided to "low-income consumers" in all regions of the nation. The rules require low- income support to be competitively and technologically neutral through equitable and nondiscriminatory contributions from all providers of interstate telecommunications services, and by allowing all eligible telecommunications carriers, including wireless carriers, to receive support for offering Lifeline and Link Up service. 11 Eligibility for Lifeline and Link Up In states that provide state Lifeline and Link Up support, Lifeline and Link Up are available to all subscribers who meet state eligibility requirements. Although states have some latitude in selecting means tests, state commissions must establish narrowly targeted qualification criteria that are based solely 8 Low income households, as defined in section 6 of this report, are households with an income below $10,000 in 1984 dollars. In addition, states with eligible residents of tribal lands must ensure that their qualification criteria are reasonably designed to apply to residents of tribal lands, if applicable. 12 To receive Lifeline and Link Up in a state that does not mandate state Lifeline support, consumers must certify that their household income is at or below 135% of the Federal Poverty Guidelines, or that they participate in one of the following seven federal programs: Medicaid, Food Stamps, Supplemental Security Income (SSI), Federal Public Housing Assistance (Section 8), the Low-Income Home Energy Assistance Program (LIHEAP), the National School Lunch Program’s free lunch program, or Temporary Assistance for Needy Families (TANF). 13 In such states, carriers must obtain signed statements from the consumer certifying that he or she receives benefits from one of these programs, or that the consumer’s household meets the income requirement, identifying the particular program and agreeing to notify the carrier if he or she ceases to participate in the program or programs or if the consumer’s income exceeds the income requirement. 14 Subscribers living on tribal lands qualify to receive federal Lifeline support if: (1) they qualify under state criteria in a state that provides Lifeline support; (2) they certify that their household income is at or below 135% of the Federal Poverty Guidelines; (3) they certify that they receive benefits from one of the seven federal programs listed above; or (4) they certify that they participate in one of the following additional federal assistance programs: Bureau of Indian Affairs General Assistance (GA), Tribally- administered Temporary Assistance for Needy Families (Tribal TANF), or Head Start (meeting the income-qualifying standard). 15 Lifeline Support Under the Commission’s rules, there are four tiers of federal Lifeline support that are available monthly. All eligible subscribers receive Tier 1 support, which provides a discount equal to the carrier’s subscriber line charge. 16 Tier 2 support provides an additional $1.75 per month in federal support, if all relevant state regulatory authorities approve such a reduction. 17 (All fifty states have approved.) Tier 3 of federal support is based on the amount of additional state support mandated by the relevant state or otherwise provided by carriers. Eligible subscribers living on tribal lands also qualify to receive Tier 4 support if they meet the eligibility standards described above. Tier 4 support provides up to an additional $25 per month towards reducing basic local service rates. Eligible subscribers living on tribal lands that receive Tier 4 support must pay at least $1 a month for local phone service, after the discount. The Commission’s Link Up program provides qualified low-income individuals with a federally- financed 50% discount (up to a maximum $30 discount) on initial connection charges. 19 In addition, these subscribers can choose to schedule deferred payments of up to $200 over a one-year period, with the customary interest charges paid by federal support. 20 Eligible residents of tribal lands can receive additional Link Up support to fully cover any charges between $60 and $130, representing up to a maximum of $100 in discounts on initial connection charges of $130 or more. 21 Services Basic local service must include, at a minimum: single-party service, voice grade access to the public switched telephone network, Dual Tone Multifrequency signaling or its functional digital equivalent, access to emergency services, access to operator services, access to interexchange service, access to directory assistance, and toll limitation. The federal program compensates eligible telecommunications carriers for toll-limitation based on the carrier's incremental cost of providing toll- limitation services. 22 Advertising 18 47 C.F.R. § 54.403(a)(3). 19 47 C.F.R. § 54.411(a)(1). 20 47 C.F.R. § 54.411(a)(2). 21 47 C.F.R. § 54.411(a)(3). 22 47 C.F.R. § 54.403(c). 2 - 5 Carriers offering Lifeline and Link Up are required to publicize the availability of those programs using media of general distribution “in a manner reasonably designed to reach those most likely to qualify for support.” 23 Support Mechanism The federal portion of the program is funded by the federal universal service support mechanisms, which include contributions from providers of interstate and international telecommunications, including payphone aggregators and private network operators that offer service to others for a fee on a non- common-carrier basis. These carriers and service providers may pass on contribution expenses to their customers. The FCC monitors subscriber participation and telephone usage to determine program benefits and costs. 24 Historical tables for subscribership and carrier payments by state can be downloaded from the Monitoring Report’s Low-Income Support section of the Wireline Competition Bureau Statistical Reports website at www.fcc.gov/wcb/iatd/stats.html. Table 2.1 reports tribal and non-tribal Lifeline subscriber and Link Up beneficiary data for years 1987 through 2006. Table 2.2 and Chart 2.1 report annual low-income support payments for years 1988 through 2006. Table 2.3 reports Lifeline monthly support by state or jurisdiction for both federal and state support as of February 2006, and indicates the additional contribution from the federal program to reduce local rates where states have authorized statewide or carrier-specific intrastate local rate reductions. The table indicates the minimum, maximum and average non-tribal support provided by carriers in each state or jurisdiction. Table 2.4 reports low-income support payments by state or jurisdiction for Lifeline and Link Up for years 2001 through 2006. American Indian and Native American tribal Lifeline Tier 4 and Link Up data are also reported. Total carrier payments data include the carrier's incremental cost of providing toll- limitation services (TLS) in each state or jurisdiction. Table 2.5 reports total Lifeline, Link Up, and TLS payments for each study area by state or jurisdiction for years 2005 and 2006. Lifeline Link Up Lifeline and Link Up Support Payments (Dollar Amounts in Millions) 1 Effective in 1998, the federal Lifeline support mechanism was expanded so that a basic level of assistance would be provided in all states. Additional federal support is also provided wherever a state chooses to provide matching assistance. Prior to the expansion, states were required to match all federal support with their own state support, and if the state provided no support, then no federal support was available in that state.
